Michelle Bettencourt, owner of above named stallion, will herein be refered to as Breeder.
This service is engaged subject to the following:
1) A booking fee of $150.00 of the above fee is payable with this contract and the balance
of $450.00 will be payable prior to the mare arriving to be covered.
2) A photostatic copy of registration papers (both sides) should be attatched to breeding
contract.
3) The Mare Owner shall agree that each mare offered for breeding shall be in sound
breeding condition and free from infection or disease. The Mare Owner will provide the
breeding farm with a written breeding history.
4) Live Foal Guarantee. Live foal means the foal shall stand and nurse (48 hrs). It is
understood that if the mare proves barren, aborts her foal or if the foal is still-born, a
breeding will be guaranteed the following year only, providing notification is given.
Proper notification shall be defined as follows: Written certification by a licensed
veterinarian within seven days that the mare has slipped or produced a non-viable foal.
Mare owner certifies that such abortion or death did not result from any omission of the
Mare Owner subsequent to the mare's departure from farm. Rebreed privileges extended
beyond the following year shall be subject to an additional fee.
5) The breeding season for this contract shall begin February 2004 and close June 1, 2004.
No new mares will be accepted for breedings after the first of May unless by special
arrangements agreed upon by both parties.
6) It is further agreed that should the above named stallion die, or become unfit for
service, the Mare owner shall be entitled to a refund of stud fee. Or if the above named
mare dies during the breeding season then the Mare Owner may substitute another mare.
7) A breeders certificate will be issued to Mare Owner after all expenses have been paid
in full and upon notification of birth of the foal.
8) When the above named Mare Owner signs and returns one copy of this contract to the
Breeder, it will then be a binding contract on both parties, subject to the terms and
conditions. This contract is not valid unless completed in full.
